By accessing or using MoanaAI ("the Service"), provided by Moana Digital Solutions ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
MoanaAI is a lead capture and management platform designed for trade shows, conferences, and events. The Service allows you to create events, build registration forms, scan QR codes, collect leads, and send follow-up communications.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorised use of your account
- Be responsible for all activities that occur under your account
4. Acceptable Use
You agree not to use the Service to:
- Collect personal data without the knowledge or consent of the individuals concerned
- Send spam, unsolicited messages, or marketing communications without proper consent
- Upload malicious code, viruses, or any harmful content
- Attempt to gain unauthorised access to other accounts or systems
- Violate any applicable laws or regulations, including privacy and data protection laws
5. Data Ownership
You retain full ownership of all data you collect through the Service, including lead information, event data, and any custom content. We do not claim ownership of your data and will not sell, share, or use your data for purposes other than providing the Service.

7. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavour to provide advance notice of planned downtime.
8. Limitation of Liability
To the maximum extent permitted by New Zealand law, Moana Digital Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may also close your account at any time by contacting us. Upon termination, your data will be retained for 30 days before being permanently deleted, unless you request immediate deletion.
10. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
